WHAT HAPPENED: The Department of Homeland Security (DHS) changed the rules for the “9-11 Biometric Fee.” Starting September 9, 2026, employers must pay this fee for every H-1B or L-1 extension request — even when you stay with the same employer. The fee was already required for first-time H-1B or L-1 applications.

WHO IT AFFECTS: H-1B and L-1 workers who need to extend their stay in the U.S., and the employers who file those extension petitions. The change applies to extension petitions submitted on or after September 9, 2026.

WHAT TO DO NOW:

- If your H-1B or L-1 status will need an extension on or after September 9, 2026, tell your employer about this new fee.

- Ask your employer or immigration attorney to confirm the 9-11 Biometric Fee is included with your extension petition.
