WHAT IT IS:

Form I-829 is the petition you use to remove the conditions on your permanent resident status. You need it if you got your 2-year conditional green card through a qualifying investment in a U.S. business (the EB-5 program). Approval gives you full, permanent resident status without conditions.

WHO NEEDS IT:

You must file this form if you (and your dependents, such as your spouse and unmarried children under 21) were granted conditional permanent residence based on an EB-5 investment. The conditional green card is valid for 2 years, and you must ask to remove the conditions before it expires.

HOW TO FILE:

1. Check your filing window. You can file only during the 90-day period right before your conditional residence expires. Your Green Card’s expiration date is the end of that 2‑year period. Visit the USCIS “When to File” page to find your exact 90‑day start date. If you file too early, your petition may be rejected.

2. Get the correct form. Download Form I-829 from the USCIS website. You must use the exact edition shown on the page; do not mix pages from different editions. The current form edition date is on the bottom of every page.

3. Complete the form carefully. Fill out every part. The form will be rejected if any of these fields are blank:

- Part 1 – Basis for Petition

- Part 2 – Information About You (Family Name, Alien Registration Number, Date of Birth, Date of Admission as a Conditional Permanent Resident, Mailing Address)

- Part 3 – Information About Your Current or Former Conditional Permanent Resident Spouse (Date of Birth, if applying with you)

- Part 4 – Information About Your Children (Date of Birth, if applying with you)

4. Sign the form. An unsigned form will be rejected.

6. Mail your package. Send everything to the USCIS Dallas Lockbox:

7. If you miss the 90‑day window: File as soon as possible and include a written explanation of why you are late. USCIS may accept it only if you show good cause and extenuating circumstances. If you do not file at all, your conditional status will end and you could be removed from the United States.

COMMON MISTAKES:

- Using an old form. Always check you have the current edition (01/20/25) and that all pages are from the same edition.

- Missing signature. Any unsigned form will be rejected.

- Filing too early. Do not send the form before your 90-day window opens; USCIS may reject it.

- Leaving required fields blank. If any of the sections listed above are empty, the form will be rejected. Read the official instructions to make sure you include all supporting evidence.
