Rule Change for R-1 Religious Workers: No More 1-Year Absence
TITLE: Rule Change for R-1 Religious Workers: No More 1-Year Absence
WHAT HAPPENED: The Department of Homeland Security (DHS) removed the rule that certain R-1 religious workers had to leave the U.S. and stay outside for 1 full year before coming back in R-1 status. This change is effective January 16, 2026.
WHO IT AFFECTS: R-1 religious workers (people doing religious work for a legitimate nonprofit church, mosque, synagogue, or similar organization) who have already reached or will reach their maximum allowed time in R-1 status.
WHAT TO DO NOW:
- If you are an R-1 worker nearing the end of your maximum stay, talk to your religious organization’s leadership or legal contact immediately.
- Do not leave the U.S. assuming the old 1-year-abroad rule still applies — the rule changed on January 16, 2026.
- Speak with an immigration attorney about whether this directly helps you extend your work or adjust your plans. This alert does not mean you automatically get more time; it removes a penalty for returning.
- (check the source) for details on R-1 maximum stay and readmission procedures.
