I-751: Petition to Remove Conditions on Residence

TITLE: I-751: Petition to Remove Conditions on Residence

WHAT IT IS:

Form I-751 is the application you file to remove the conditions on your permanent resident status (your “green card”). If you became a conditional resident through marriage to a U.S. citizen or lawful permanent resident, this form asks USCIS to make your green card permanent.

WHO NEEDS IT:

You need this form if you are a conditional permanent resident who got that status through marriage. This includes:

- You are filing jointly with your U.S. citizen or lawful permanent resident spouse.

- You are filing a separate joint petition with your U.S. citizen or lawful permanent resident stepparent (if you were not included in your parent’s petition).

- You need to file individually because of:

– Extreme hardship if you were removed from the United States,

– Death of your spouse or stepparent (marriage was entered in good faith),

– Divorce or annulment of the marriage (marriage was entered in good faith),

– Battery or extreme cruelty by your U.S. citizen or lawful permanent resident spouse during the marriage, or

– Battery or extreme cruelty by your parent or your U.S. citizen or lawful permanent resident stepparent during the marriage.

HOW TO FILE:

1. Determine your filing window.

- If you file jointly with your spouse: You must file during the 90‑day period immediately before your conditional residence expires. Use the “When to File Your Petition to Remove Conditions” page (linked on the official USCIS Form I-751 page) to find the first day of that window. Filing before that date may cause your form to be rejected.

- If you file a separate joint petition with a stepparent, or you file individually for one of the waiver reasons: You may file at any time before your conditional permanent resident status expires.

2. Gather the required documents.

- Copies of the front and back of your Permanent Resident Card.

- Copies of the front and back of the Permanent Resident Cards of any conditional permanent resident children you include in your petition.

- Evidence that your marriage was entered in good faith and not to get around immigration laws. Submit as many documents as you can to show this, such as documents that demonstrate the circumstances of the relationship.

3. Prepare translations if any documents are in a foreign language.

- You must include a full English translation for every foreign‑language document.

- Include a certification from the translator stating that the translation is complete and accurate, and that the translator is competent to translate from that foreign language into English.

4. File your petition online or by mail.

- To file online: Create a USCIS online account first (visit the “How to Create a USCIS Online Account” page). Submit Form I-751 through your account. You will receive a receipt notice.

- To file by mail: Go to the “Direct Filing Addresses for Form I-751” page on the USCIS website to find the correct mailing address. Print the form and mail it with all supporting documents.

5. Use only the official, current form edition.

- Make sure the edition date (at the bottom of the form) is the one listed on the USCIS Form I-751 page. If you mail the form, all pages must come from the same edition, the edition date and page numbers must be visible on every page, and no pages may be missing. USCIS may reject a form with mismatched or missing pages.

6. Pay the correct filing fee. Check the USCIS Fee Schedule for Form I-751 (see FEES below).

FEES:

The source page does not list the fee. You must check the official fee schedule on the USCIS website. (check the official fee schedule)

CURRENT EDITION & DEADLINES:

The edition date shown on the USCIS page is 04/01/24. The edition date is at the bottom of each page, using mm/dd/yy format. Always download the form directly from www.uscis.gov/i-751 to be sure you are using the current edition. (Check the current edition on the official page.)

For the filing deadline: if you are filing jointly with your spouse, you must file exactly during the 90‑day window before your conditional residence expires. The official “When to File” page will help you calculate the first day of that window. For other filing situations, you may file any time before your status expires. No other calendar date is given in the source.

COMMON MISTAKES:

- Filing too early for a joint petition. If you file before the 90‑day window, USCIS may reject your form. Wait until that window opens.

- Using an outdated form or mixing pages from different editions. All pages must come from the same download; missing pages or mismatched editions can lead to rejection.

- Forgetting to include full English translations and the translator’s certification for any document in a foreign language.

- Sending original documents unless USCIS specifically asks for them. Usually, copies are enough. The checklist warns: “Do not send original documents unless specifically requested.”

WHERE TO GET THE FORM:

Always go to the official USCIS page: https://www.uscis.gov/i-751. Download the form and instructions from that page so you have the correct edition. We do not host the form.
